1. About These Terms

These Terms of Service ("Terms") are a legal agreement between you and Mystics of Sound Ltd ("Mystics of Sound", "MoS", "we", "us", or "our"). They govern your access to and use of the Mystics of Sound website, mobile applications, and all related services (collectively, the "Platform").

By accessing or using the Platform, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not use the Platform.

2. Account Registration

To access most Platform features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Promptly update information that becomes inaccurate
• Notify us immediately of any unauthorised access to your account
• Accept responsibility for all activity occurring under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Platform Use and Conduct

You agree not to use the Platform to:

• Violate any applicable law or regulation
• Infringe on any intellectual property rights
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Transmit spam, malware, or disruptive code
• Scrape or systematically collect Platform data without permission
• Impersonate any person or entity
• Engage in any activity that disrupts Platform operation

4. Artist and Organizer Accounts

Artist and organizer accounts are subject to additional terms beyond these general Terms of Service. By applying for and accepting an artist or organizer account, you additionally agree to:

• Provide accurate representations of your identity, experience, and professional history
• Honour confirmed bookings facilitated through the Platform
• Maintain professional conduct in all Platform interactions
• Pay applicable Platform fees as described in your account tier
• Comply with applicable local licensing, tax, and performance regulations

MoS reserves the right to remove artist or organizer profiles that misrepresent credentials, receive substantiated complaints, or otherwise violate these Terms.

5. Booking and Transactions

The Platform facilitates booking inquiries and connections between artists and organizers. MoS is not a party to the underlying performance or service agreement between artists and organizers. You acknowledge that:

• MoS charges a platform fee on confirmed bookings (currently 8% of booking value)
• Artists and organizers are independently responsible for their contractual agreements
• MoS does not guarantee artist availability or organizer fulfilment of engagements
• Disputes between artists and organizers are the responsibility of those parties
• Marketplace transactions are final unless otherwise specified in product listings

6. Intellectual Property

All content on the Platform created by MoS — including design, text, graphics, logos, and software — is owned by or licensed to Mystics of Sound Ltd and protected by applicable intellectual property laws.

By uploading content to the Platform (including artist profiles, music samples, images, and descriptions), you grant MoS a worldwide, non-exclusive, royalty-free licence to display, reproduce, and distribute that content in connection with operating and promoting the Platform. You retain all ownership of content you upload.

You represent that you have all rights necessary to grant this licence and that your content does not infringe on any third party's rights.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our data practices as described in the Privacy Policy.

8. Disclaimers and Limitation of Liability

The Platform is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, MoS disclaims all warranties including fitness for a particular purpose, merchantability, and non-infringement.

In no event shall MoS be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim shall not exceed the greater of €100 or the amount you paid to MoS in the 12 months preceding the claim.

9. Termination

You may close your account at any time by contacting us. We may suspend or terminate accounts that violate these Terms, misrepresent credentials, or engage in conduct harmful to other users or the Platform.

Upon termination, your right to access the Platform ceases. Provisions that by their nature should survive termination (including IP rights, limitation of liability, and dispute resolution) shall continue in effect.

10. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating formal proceedings, we encourage you to contact us to resolve disputes informally. Many issues can be resolved quickly through our support team.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or Platform notification. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
